1. ACCEPTANCE OF TERMS
By accessing www.onlinemovers.miami or using any of our services, you agree to be legally bound by these Terms & Conditions. If you do not agree, you must discontinue use immediately.
Online Movers & Storage operates in full compliance with Florida Statutes Chapter 507 (Household Moving Services), as amended by Senate Bill 304 (effective July 1, 2024), the Miami-Dade County Moving Ordinance, and Federal Motor Carrier Safety Administration (FMCSA) regulations. We are registered with the Florida Department of Agriculture and Consumer Services (FDACS) under FL Mover Reg. MR 01296, and with the Miami-Dade County Consumer Protection Division (DOT #3381414).
These Terms apply to all customers, website visitors, and any party entering into a service agreement with OMS.
2. SERVICES PROVIDED

Service availability may vary by location and is subject to scheduling and resource availability. We reserve the right to modify or discontinue any service at any time.
3. QUOTES & PAYMENT
All estimates β whether provided online, by phone, or in writing β are non-binding and subject to adjustment based on final service requirements, access conditions, and materials used, in accordance with Florida Statutes Β§507.
Important: Under Florida Statutes Β§507, it is a felony for a carrier to withhold or refuse to deliver your goods once the amount stated on the Bill of Lading has been paid.
Additional charges may apply for: stairs, long carry, elevator delays, shuttle service, parking restrictions, storage, or any undisclosed condition materially affecting the scope of work.

5. LIABILITY & INSURANCE COVERAGE
OMS provides valuation coverage in compliance with Florida Statutes Β§507 and Miami-Dade County Moving Ordinance, which require a minimum cargo liability coverage of $10,000 combined single limit at $0.60 per pound per article. Customers may select from the following options. If no selection is made, Option 1 applies by default.
Option 1 β Standard Liability (Included, Default)Carrier liability is limited to $0.60 per pound per article, as mandated by Florida Statutes Β§507 and Miami-Dade County Ordinance. Included at no cost.Example: A 30 lb TV damaged beyond repair = maximum compensation of $18.00. This may not reflect the item's actual market value.
Option 2 β OMS Protection PlanItems may be repaired, replaced, or settled at depreciated value. Zero deductible. Excludes items exceeding $100/lb. For storage, the same coverage must be maintained throughout loading, storage, and delivery.
Option 3 β Full Replacement Cost Insurance (3rd Party)Must be purchased directly by the customer through a third-party provider prior to the move. Subject to provider terms and deductibles. By selecting this option, the customer waives all claims against the carrier and must file claims directly with their insurance provider.
High-Value Items: Any item valued over $100 per pound must be declared in writing to your moving consultant before the move, pursuant to Florida Statutes Β§507. Liability for undeclared high-value items is limited to $0.60/lb regardless of coverage selected.
Electronics Coverage DisclaimerOMS is not responsible for the internal performance or operability of electronic devices (TVs, computers, gaming consoles, audio systems, etc.), regardless of external condition upon delivery. Items must be packed in original manufacturer packaging or professionally packed by our team to be eligible for any electronics claim. Liability is limited to visible external damage only.

6. CUSTOMER RESPONSIBILITIES

9. DISPUTE RESOLUTION
Disputes shall be governed by the laws of the State of Florida, with exclusive jurisdiction in Miami-Dade County. The prevailing party is entitled to recover reasonable attorney's fees and costs under Florida law. Customer agrees not to initiate chargebacks or payment disputes through any financial institution once services have been rendered.

11. MODIFICATIONS TO TERMS
OMS reserves the right to update these Terms & Conditions at any time. The most current version will always be available at www.onlinemovers.miami. Continued use of our services constitutes acceptance of any revised terms.

13. ENTIRE AGREEMENT
These Terms & Conditions, together with any signed service agreements or addenda, constitute the entire agreement and supersede all prior representations. No modification is valid unless in writing and signed by an authorized representative of OMS. This agreement is governed by Florida Statutes Chapter 507, Miami-Dade County Moving Ordinance, and applicable FMCSA regulations.

Online Movers & Storage is not responsible for internal performance or operability of electronic items such as televisions, computers, gaming consoles, stereo systems, printers, or similar devices, regardless of their external condition upon delivery.
All electronics must be:
If these conditions are not met, claims for non-functional or damaged electronics will not be honored.
Note: The functionality of electronics cannot be verified before the move, and liability is limited to visible external damage only.
